- Agreement to These Terms
These Terms of Service (“Terms”) govern your access to and use of the website located at https://www.carepathinjury.com and any related pages, forms, patient portals, appointment request tools, and text messaging services (collectively, the “Site” and “Services”) operated by CarePath Injury Centers of Pennsylvania doing business as CarePath Injury Centers (“CarePath,” “we,” “us,” or “our”).
By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy which are incorporated by reference. If you do not agree to these Terms, do not use the Site.
You must be at least 18 years of age, or an emancipated minor, or have the consent of a parent or legal guardian, to use the Site.

The content on this Site is provided for general informational purposes only and is not medical advice.
Nothing on this Site is intended to be a substitute for professional medical advice, diagnosis, or treatment. Never disregard professional medical advice or delay seeking it because of something you have read on this Site.
Use of this Site does not create a physician-patient relationship. A physician-patient relationship is established only when you are formally accepted as a patient, complete our intake and registration process, and are evaluated by one of our licensed providers at one of our locations.
Submitting a form, requesting an appointment, sending a message, or exchanging text messages with us does not, by itself, create a treatment relationship or obligate us to accept you as a patient.

- No Guarantee of Results
Individual results vary. Any descriptions of treatments, procedures, recovery timelines, patient experiences, or outcomes appearing on this Site are illustrative only and do not constitute a promise, warranty, or guarantee of any particular result. Treatment recommendations depend on individual clinical evaluation.
- No Legal or Insurance Advice
CarePath provides medical care. We do not provide legal advice, and nothing on this Site should be construed as legal advice regarding a workers’ compensation claim, personal injury claim, insurance coverage, or settlement. We do not guarantee that any insurer, carrier, or third party will authorize, cover, or pay for any service. You are responsible for understanding your own coverage and legal rights, and you should consult a licensed attorney regarding any legal matter.
Any reference to attorneys, law firms, funding companies, or other third parties on this Site is informational and does not constitute an endorsement or recommendation.
- Appointment Requests and Online Forms
Appointment requests submitted through the Site are requests only and are not confirmed until a CarePath representative contacts you and confirms the appointment. We do not guarantee availability at any particular time or location.
Do not submit sensitive clinical details, diagnoses, or detailed medical history through general contact forms. Standard web forms and email are not fully secure. Use only the fields requested, and provide clinical information through our secure intake process (third party linked form) or in person.
You agree that all information you provide through the Site is accurate, current, and complete, and that you will update it as needed.
- Text Message (SMS) Terms
If you provide your mobile number and consent to receive text messages from CarePath, the following terms apply. These terms supplement, and do not replace, the SMS section of our Privacy Policy.
Consent. By providing your mobile number and opting in — through a form on this Site, on paper or digital intake documents, by texting a keyword to one of our numbers, or verbally to a staff member — you consent to receive text messages from CarePath at that number, including messages sent using an automatic telephone dialing system or other automated technology.
Consent is not a condition of treatment or of purchasing any goods or services.
Message Types. Messages may include appointment confirmations and reminders, intake and form links, arrival and check-in notices, care and follow-up instructions, billing and payment notifications, records or documentation requests, responses to your inquiries, and practice notices such as closures or schedule changes. We do not send promotional or marketing texts unless you have separately opted in to receive them.
Message Frequency. Message frequency varies based on your care and your interaction with us.
Cost. Message and data rates may apply. CarePath does not charge for text messages; your wireless carrier’s standard rates apply.
Opt Out. Reply STOP to any message to cancel. You may also reply QUIT, END, CANCEL, UNSUBSCRIBE, or OPTOUT. You will receive a single confirmation message, after which no further messages will be sent to that number unless you opt back in.
Delivery. Carriers are not liable for delayed or undelivered messages. Message delivery depends on your wireless carrier and is not guaranteed.
Mobile Information Sharing. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties. We share mobile information only with vendors that support delivery of our messaging program, subject to contractual restrictions and, where applicable, a HIPAA Business Associate Agreement.
Security. Standard SMS is not encrypted. By opting in, you acknowledge that text messages may be viewed by others with access to your device or intercepted in transit, and you accept that risk. You agree to notify us promptly if your mobile number changes or if you no longer control the number you provided.
Number Reassignment. You represent that you are the subscriber or customary user of the mobile number you provide and that you have authority to consent to receive messages at that number.
- Acceptable Use
You agree not to:
- Use the Site for any unlawful purpose or in violation of any applicable law or regulation;
- Attempt to gain unauthorized access to any portion of the Site, our systems, our networks, or any patient information;
- Interfere with or disrupt the Site, including through viruses, malware, denial-of-service attacks, or excessive automated requests;
- Use any robot, scraper, spider, or other automated means to access or extract data from the Site;
- Impersonate any person or misrepresent your affiliation with any person or entity;
- Submit false, misleading, or fraudulent information, including in connection with any claim or billing matter;
- Post or transmit content that is unlawful, defamatory, harassing, abusive, or infringing;
- Reverse engineer, decompile, or attempt to derive the source code of any part of the Site;
- Use the Site or its content for any commercial purpose without our prior written consent.
We may suspend or terminate your access to the Site at any time, without notice, for conduct we believe violates these Terms.
- Intellectual Property
The Site and all of its content — including text, graphics, logos, images, video, page layout, design, and software — are owned by CarePath or its licensors and are protected by United States and international copyright, trademark, and other intellectual property laws.
“CarePath Injury Centers” and associated logos and marks are trademarks of CarePath. You may not use them without our prior written permission.
You may view, download, and print content from the Site for your own personal, non-commercial use only. All other use, reproduction, modification, distribution, or public display is prohibited without our prior written consent.
- Third-Party Links and Services
The Site may contain links to third-party websites, tools, or services — including insurers, imaging centers, referral partners, payment processors, scheduling platforms, and informational resources. These links are provided for convenience only.
We do not control and are not responsible for the content, privacy practices, accuracy, or availability of third-party sites or services. A link does not imply endorsement. Your use of any third-party site is at your own risk and is governed by that party’s terms and privacy policy.
- Privacy
Your use of the Site is also governed by our Privacy Policy and, with respect to protected health information.
Information you submit through general website forms is not necessarily protected health information under HIPAA until a treatment relationship is established, but we handle it in accordance with our Privacy Policy.
- Disclaimer of Warranties
THE SITE AND ALL CONTENT AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
To the fullest extent permitted by law, CarePath disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the Site will be uninterrupted, timely, secure, or error-free; that defects will be corrected; that the Site is free of viruses or other harmful components; or that any content is accurate, complete, current, or reliable. Medical information changes; content may become outdated.
Nothing in these Terms limits or excludes liability that cannot lawfully be limited or excluded, and nothing in these Terms is intended to limit any claim arising out of the actual provision of medical treatment.
- Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, CAREPATH AND ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, PROVIDERS, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SITE — WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER THEORY, AND EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100.00).
This limitation applies to claims arising from the Site and its content only. It does not apply to, and does not limit, any claim arising out of the professional medical services we provide.
Some jurisdictions do not allow certain limitations of liability; in those jurisdictions, our liability is limited to the greatest extent permitted by law.
- Indemnification
You agree to indemnify, defend, and hold harmless CarePath and its owners, officers, directors, employees, providers, contractors, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site, your violation of these Terms, your violation of any law, or your infringement of any third-party right.
- Changes to These Terms
We may modify these Terms at any time. The revised Terms will be posted on the Site with an updated “Last Updated” date. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms. Review these Terms periodically.
- Governing Law and Venue
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law principles. You agree that any dispute arising out of or relating to these Terms or the Site shall be brought exclusively in the state or federal courts located in [COUNTY] County, Pennsylvania, and you consent to the personal jurisdiction of those courts.

These Terms, together with our Privacy Policy and Notice of Privacy Practices, constitute the entire agreement between you and CarePath regarding your use of the Site, and supersede any prior agreements or understandings on that subject.
These Terms do not govern the professional services relationship between CarePath and its patients, which is governed by separate patient agreements, consents, and financial policies executed at the time of registration.
